Whilst the concept of modular construction has been around for a while, it continues to gain traction in the broader construction sector (in March 2025, the Federal Government announced it would be providing a $54 million funding package to accelerate the adoption of prefabricated and modular construction methods as part of its commitment to housing in Australia, by way of example).

This webinar will build on the evolution of modular construction in the sector and explore key legal principles and risks in (modular) project procurement. The presentation will consider the contractual structuring of such projects and provide some insight into the “pinch points” that can arise, from a contractual perspective, including design (and defect) risk in the modular components, intellectual property rights, interface risks, title and risk, contractual delays and more. Understanding these broader issues can be valuable whether providing design services, contract administration or generally involved in a project involving modular components.
